1. Earnings!
I understand that I will earn 60% of the gross sales actually received by JBF Texoma for the items I offer for sale. If I choose the "Pay Later" consignor fee option, a $18 consignor fee will be deducted from my check.
If I am choosing the Valet selling option, I am responsible for paying my valet tagger according to the percentage and fees we agree on (I will be given the option of having this deducted from my check). JBF does not set the valet tagger payout percentage or fees - each valet tagger sets their own prices.
2. Tags & Prices
I request that JBF Texoma sell the items I am consigning for the price listed on the bar-coded tags that I have created. I understand that the price sold will be controlled by the printed tag attached to the item at the sale, and not any subsequent changes made in the online tagging system. I verify that I have no handwritten information on any tags and understand that handwritten changes are not accepted.
I understand that if the printed tag includes a star (color or black & white), my item will remain at FULL PRICE; and if there is NO star on the printed tag, my item will be sold at 50% of the tag price during the Half Price PreSale & Half Price Public Sale. For your protection, no cross outs on tags.
I understand that any items marked Donate can be sold for 75% of the tag price during the private presale that is only available to JBF team leaders and team members who work during the sort shift. This presale occurs after the 50% off sale.
I understand that JBF Texoma will be hosting a Bargains & Blessings shopping time at the end of the 50% off sale where shoppers can pay a flat fee per bag that they fill with items marked to Donate. That fee will be paid directly to our charity partner(s).
3. Condition of Items:
I verify that each item I am consigning is clean, sanitized, odor-free, stain-free, in good operating condition, is not defective, broken, or damaged in any way, and is priced according to JBF Texoma standards.
No item is the subject of any pending or threatened recall notice or other consumer protection enforcement action; and I know of no reason why any item offered for sale by me would cause any injury to another. Each item offered for sale by me is in good operating condition, reasonable wear and tear expected, and not defective, broken or damaged in any way. Any repaired item was repaired by the original manufacturer or in accordance with the original manufacturer warranty program.
If any item is returned to me because it is dirty, stained, out of season, has smoke/pet/mildew or other odor, defective, missing parts, does not work, or recalled, I understand that I will not be paid any amount for the sale of that item.
4. Cribs & Car seats:
Car seats must be less than 5 years old, and you must bring a car seat waiver with you at drop-off (can be found on our How to Sell page at texoma.jbfsale.com) along with the owners manual (if you don't have the original, you can usually find one online, or to save trees, you can print a QR code that will send the new owner to the online manual to print).

5. Photography:
I understand that, at times, JBF takes photographs & video of its sales for promotion, and if I do not wish for my image to be used in JBF promotions, I will notify the photographer at the time a picture is taken. Otherwise, I agree to allow my image to be used in JBF sale promotions. I agree that no royalty or other payment is due me because of the use of any such image.
6. Online Sales:
I agree to allow JBF Texoma to show my items for sale online. I understand that all terms and conditions are the same for online sales.
7. Merchandising:
I understand that JBF Texoma uses strategic merchandising in order to sell as many items as possible. If lack of space is an issue, sometimes items might have to start out being merchandised in a basket or on the floor, with the goal of moving those items up and spreading them out as soon as space is available. If I bring multiples of the same item, and if space is an issue, I understand that JBF Texoma may pull excess multiples and replenish them on the floor once there is space.
8. Pickup:
If you are opting to pick up your items after the sale, you must arrive before the stated closing time and after the stated opening time. Early entrance will not be allowed. All items not picked up by the closing time will be donated. No exceptions. If we are ready early, we will post on Facebook and send out a text.
If you want to designate someone else to pick up your items for you, please text 903-307-5595 to let us know. Whoever picks up for you will need a photo ID to pick up your items.
9. Checks:
I understand that checks will be sent via email within 10 days of the last day of the sale. I agree to cash my JBF consignor check within 90 days of the date the check is issued. There will be a $35 fee for any check that must be reissued.
10. Representations & Warranties:
As a condition of selling items in a Just Between Friends Sale, I represent, warrant, and agree that the following are true and correct in all respects: I own the items offered for sale. I have full authority to sell the items without the consent of any other person. Each item is free of all liens, claims, and encumbrances of every kind.
I understand and agree that Just Between Friends (JBF) of Texoma and Just Between Friends Franchise Systems, Inc. are not responsible for fire, loss, theft, or damage to the items I am consigning. I also understand that JBF Texoma is only a broker or agent for the consignor. JBF Texoma has no obligation to pay for unsold items. Ownership of items remains with the consignor.
I agree to waive, relinquish, discharge, release, and covenant not to sue Just Between Friends Texoma ("JBF Franchisee") and Just Between Friends Franchise Systems, Inc. ("JBF Franchisor") or any of either entity's members, officers, directors, agents, employees, and volunteers for any and all claims of injury, damage, or loss that any purchaser of the items I am consigning may have or that may accrue to any purchaser of the items arising out of, connected with, or in any way associated with such consigned items.
By registering as a consignor, I confirm that:
1) I have read and fully understand this Consignor Agreement in its entirety, including the Representations and Warranties stated above;
2) I agree to and warrant as stated above; and
3) No one has made to me representations, statements, or inducements that change or modify anything written in this Consignor Agreement.
